3. Counter-Notification Procedure
If you believe that material you posted or uploaded was removed or disabled by mistake or misidentification, you may send our Designated Agent a counter-notification. Your counter-notification must include all of the following:
Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled (for example, URL, in-app link, channel/creator name, and timestamp if applicable).
A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside of the United States, for any judicial district in which This Just In may be found), and that you will accept service of process from the person who provided the original DMCA notice or that person’s agent.
Upon receipt of a valid counter-notification, we may forward a copy of the counter-notification to the original complaining party and inform them that we may restore the removed content in 10–14 business days, unless our Designated Agent receives notice that a court action has been filed to restrain you from engaging in infringing activity relating to the material on our Services.
We may, but are not obligated to, restore the content in our sole discretion.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, it is our policy to terminate, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.
